Redefined criteria for State financial support to non-resident students
On 10 October 2019, the Luxembourg Parliament passed a bill relaxing the criteria according to which non-resident students with a parent working in Luxembourg can obtain higher education financial support from the Luxembourg State.
This bill comes as a result of the 10 July 2019 European Union Court of Justice judgement (see press release [PDF]) stating that Luxembourg's eligibility conditions for higher study financial aid were defined too restrictively with regard to the students' possible connection with the grand duchy of Luxembourg.
The new criteria are applicable, as the previous ones, to non-resident students dependent on workers affiliated with the grand duchy of Luxembourg at the time of their application for higher education financial support.
On the other hand, the new legislation will include three types of enlarged criteria:
- The period considered during which one of the parents has to be affiliated with the Luxembourg labour market has been increased from seven to ten years, while the minimum period of five cumulated years will remain unchanged
- A new criterion has been introduced, establishes a definitive link with Luxembourg, namely an affiliation of one of the parents in Luxembourg for a cumulative period of ten years
- Further new criteria have been adopted, allowing students to establish their link with Luxembourg themselves: the criteria of schooling and of residence.
The new provisions has been integrated into the existing legislation on State financial support for higher education (loi du 26 octobre 2019 portant modification de la loi modifiée du 24 juillet 2014 concernant l’aide financière de l’État pour études supérieures).
