Emplyoment of the academic staff in higher education is framed by the Law entitled 2547, the articles 23., 24., 26., 31., 36., and 50. as well as the regulation concerning the application of the  central examinations for the appointment of the teaching staff apart from the academic staff. This Law states that "Higher education institutions educates the academic staff based on the needs of the established or newly-established universities, including their own needs, in home or aborad. Research assistant positions within the frame of 35. Article, research assistans may be appointed to another university for masters and/or doctoral education under temporary status with the allocation of CoHE. Thereby having educated in an external higher education institutions, these students go back to their universities with their permanent posts."

In addition to this Law, candidate academics can go abroad for graduate education with both national and international scholarship programs. International programs are regulated with the law numbered 1416 entitled 'The law concerning the students to be sent to the foreign countries'. Within this perspective, most of the academicians necessiated by the natinonal universities are educated in national universities, and few are sent to the foreign countries for their graduate education.  In the recent years, Academician Education Program (TR: Öğretim elemanı Yetiştirme Programı (ÖYP), OYP henceforth) is a system that was established to compensate for the academician need of the tertiary programs and that has become one of the major sources of all universities in terms of the academic personnel. The validation and the need for this program was later mentioned in a report by YOK, mentioning that the current academician education system is not enough for the need and future expectations of the tertiary programs in Turkey (Türk Yükseköğretiminin Bugünkü Durumu, Kasım 2005, YÖK, EN: Current Status of Turkish Higher Education, November, 2005, YOK). The tertiary programs appoint students as research assistants in line with the criteria set by the Council of higher Education and international students who hold similar qualifications.
